Ask a lawyer on the topic of Labor law

When does my fixed-term employment contract end?

Dear lawyer,

My name is Gerda Wittik and I am currently employed in a temporary position. My contract is soon coming to an end and I am unsure of the exact end date. The termination of my contract was based on a project which has now been completed. Unfortunately, my employer has not provided me with any specific information on what will happen after my contract expires.

I am concerned about my professional future and would like to have clarity on whether my contract will automatically end or if an extension is possible. Are there any legal regulations stating that my contract automatically ends once the project is completed? Or are there possibly options for an extension or conversion of my temporary contract into a permanent position?

I would greatly appreciate it if you could provide me with some possible solutions or courses of action to resolve my uncertainties regarding my employment contract. I would like to be able to plan ahead and ensure that my professional future is secure.

Thank you in advance for your assistance.

Kind regards,
Gerda Wittik

Dear Mrs. Wittik,

Thank you for your inquiry regarding your fixed-term employment contract and the uncertainties about the end of this contract. I understand your concerns about your professional future and will now outline some possible solutions and courses of action.

First of all, it is important to know that the fixed-term of an employment contract for a specific project is legally permissible. If the project for which your employment contract was fixed-term is now completed, this does not automatically mean that your contract will end. Usually, a fixed-term employment contract ends automatically on the agreed end date, unless something else has been agreed in the contract or there are legal provisions allowing for an extension or conversion to an indefinite employment relationship.

There are various legal regulations governing the fixed-term of employment contracts. For example, there is the possibility of extending a fixed-term contract if this is provided for in the original contract or in a works agreement. Extension may also be possible if there is a valid reason, such as the continued need for workers.

Furthermore, it is possible to convert a fixed-term employment contract into an indefinite one. This may be possible under certain conditions, such as if the employee has been repeatedly employed on a fixed-term basis or if the employer cannot provide a valid reason for the fixed-term.

I recommend that you first have a conversation with your employer to inquire about what will happen after your contract expires. Inform yourself about your rights and options, and seek legal advice if necessary to ensure that your professional future is secure.

I hope this information is helpful to you and I am available for further questions.

Sincerely,
Alexander Lenzner, Attorney at Law
