Ask a lawyer on the topic of Immigration law

What options do I have as an asylum seeker to improve my residence status in Germany?

Dear Lawyer,

My name is Wilhelm Zimmermann and I am an asylum seeker in Germany. I have been here for two years and have only received temporary suspension of deportation so far. I have heard that there are different ways to improve my residence status, but I am unsure about the exact steps I need to take.

Currently, I do not have a work permit and live in constant uncertainty about whether and when I will be deported. My biggest wish is to be able to stay in Germany, as I see it as a new chance for a better life. I have already learned German and am trying to integrate into society, but without a secure residence permit, this is very difficult.

I am very worried about my future and wonder if there is a way to improve my residence status and stay here long-term. Are there specific criteria I need to meet to obtain a residence permit? What steps should I take as an asylum seeker to increase my chances of obtaining a secure residence status?

I would be very grateful if you could provide me with information and advice on this matter. Thank you in advance.

Best regards,
Wilhelm Zimmermann

Dear Mr. Zimmermann,

Thank you for your inquiry and your trust in my expertise in immigration law. It is understandable that you are concerned about your future and long for a secure residence permit. Indeed, there are various ways to improve your residence status and stay in Germany in the long term.

First of all, it is important to know that the tolerated status you currently have is a temporary residence permit and is not a long-term solution. To improve your residence status, there are various paths that can vary depending on individual situations.

One possibility would be to apply for a residence permit for humanitarian reasons. For this, you must demonstrate that you are well integrated in Germany, can provide proof of German language skills, and have not committed any crimes. It is also important that you can prove that a return to your country of origin is unreasonable due to personal circumstances such as political persecution or health reasons.

Another option would be to apply for a residence permit for family reasons, for example if you are married to a German citizen or have minor children in Germany.

It is advisable to consult with an immigration lawyer to discuss your individual situation and determine the best steps for you. A lawyer can help you gather the necessary documents and prepare the application for a residence permit.

It is also important to contact the relevant immigration authorities to clarify your situation and discuss possible solutions. Stay patient and do not give up, as with the right steps and necessary support, it is indeed possible to improve your residence status and have a secure perspective in Germany.

I hope this information is helpful to you and I am happy to assist you further by answering any questions or supporting you in your matter.

Sincerely,
Leonie Eiserfelder, Attorney at Law
