Ask a lawyer on the topic of Tenancy law

Can my landlord simply terminate my lease?

Dear lawyer specializing in tenancy law,

My name is Franceska Vollbrecht and I am reaching out to you with an urgent question regarding my tenancy agreement. I have been a tenant of an apartment for three years and have not had any issues with my landlord so far. However, I recently received an unexpected notice of termination from him. I am completely surprised and unsure, as I have not violated any terms of the lease and have always paid my rent on time.

The landlord did not provide any specific reasons in the termination notice and I am wondering if he can simply terminate the agreement like that. I am worried about my home and wondering what rights I have as a tenant in this situation. Are there any possible solutions to avoid the termination or at least defend my rights? I am really concerned and hope for your professional advice on this matter.

Thank you in advance for your assistance.

Sincerely,
Franceska Vollbrecht

Dear Mrs. Vollbrecht,

I understand your concern and would like to help you in your situation. First of all, it is important to know that your landlord cannot simply terminate the lease out of the blue. In Germany, the principle of termination only applies if there is a valid reason. This means that your landlord must provide a specific reason for the termination that is recognized as a valid reason in tenancy law.

If your landlord did not specify any concrete reasons for the termination, this could indicate that the termination may be invalid. In such a case, it is important to consult a specialist lawyer in tenancy law to assess your rights and potentially take legal action.

It may be that the termination is unjustified and you can successfully defend against it. For this, it is important that you gather all documents related to your lease agreement and communication with your landlord and present them to a lawyer. They will review whether the termination is formally correct and whether other reasons for termination can be argued.

There is also the possibility of an out-of-court settlement with your landlord if the situation has escalated. A lawyer can help you negotiate such a settlement and represent your interests.

In any case, it is important that you act quickly and seek professional help. Your apartment and your home are at stake, so it is crucial that you know and defend your rights. Do not hesitate to contact me to arrange a consultation appointment and find a solution to your problem together.

Best regards,
Günther Schulz.
