Received notice of termination due to operational reasons - what to do?

Dear lawyer,

my name is Dirk Widmann and I have been working as a production worker at a medium-sized company for five years. Recently, I received a termination notice due to operational reasons, which has made me very concerned. The employer's reasoning is that due to economic difficulties, positions need to be reduced.

I am worried about my financial situation and my future, as I am the sole breadwinner for my family. I am concerned about how I can continue to support my family and how I can quickly find a new job. I also feel unfairly treated, as I have always worked loyally and diligently for the company.

Could you please explain to me what I can do in this situation? Are there ways to contest the termination for operational reasons? What steps should I take next to protect my rights and receive a fair severance package? I would be grateful for any advice and support.

Thank you in advance.

Sincerely,
Dirk Widmann

Dear Mr. Widmann,

I understand your concerns and fears regarding your redundancy dismissal and would like to help you protect your rights and possibly receive a fair severance payment.

First of all, it is important to know that redundancy dismissals are only permissible under certain conditions. Your employer must prove that there are indeed economic reasons that justify the dismissal. If you have doubts about the legality of the dismissal, you can file a protection against dismissal lawsuit at the labor court within three weeks of receiving the dismissal. There, it will be examined whether the dismissal is justified or not.

If you decide to file a protection against dismissal lawsuit, I strongly recommend that you seek representation from a specialized labor law attorney. They can help you defend your rights and negotiate a fair severance payment. In many cases, through a judicial dispute, severance payments can be obtained that exceed the statutory minimum requirements.

Furthermore, you should register as a job seeker immediately and make use of all opportunities for job placement. Inform yourself about possible support services, such as unemployment benefits, and check if you are eligible for financial assistance.

Overall, it is important to remain calm and not rush into decisions. Take your time to carefully consider all options and seek advice from an experienced attorney if necessary. I wish you success and am available for further support.

Best regards,
