Ask a lawyer on the topic of Fee law

Can I arrange a payment plan for the attorney fees?

Dear Sir or Madam,

I am reaching out to you because I urgently need help and am unsure how to cover the legal fees. A few weeks ago, I was involved in a traffic accident for which I was not at fault. Now I urgently need legal assistance to assert my claims against the opposing insurance.

Unfortunately, I currently do not have the financial means to pay the legal fees all at once. Therefore, I am wondering if it is possible to arrange a payment plan for the legal fees. I am worried that I may not be able to afford the legal advice and therefore may not be able to enforce my claims.

I am facing an uncertain situation and urgently need support to assert my rights. What options are there to arrange a payment plan for the legal fees? Are there any legal requirements or other conditions that I need to consider? I rely on your professional expertise and thank you in advance for your support.

Sincerely,
Lilli Schröter

Dear Mrs. Schröter,

I understand your concerns and can empathize with the difficult situation you are in. It is important that you assert your claims against the opposing insurance and legally protect yourself. Regarding the attorney fees, a payment plan may be a possible solution to minimize the financial burden.

In principle, it is possible to agree on a payment plan for the attorney fees with your lawyer. However, some legal aspects should be considered. It is important that a written agreement for the payment plan is made. This ensures clarity and transparency for both parties. The agreement should specify the amount of the installments, the payment dates, as well as any potential interest and fees.

Furthermore, it is advisable to discuss the possibility of a payment plan with your lawyer beforehand. Not all lawyers offer this option, so it is important to clarify this in advance. It may also be useful to discuss and potentially adjust the duration of the payment plan.

There are no specific regulations prohibiting a payment plan for attorney fees in terms of legal requirements. However, you should be aware that regardless of a payment plan, you are ultimately responsible for covering the lawyer's costs. A payment plan does not change the fact that you will ultimately have to bear the costs of the lawyer.

I recommend contacting your lawyer and finding a solution together that fits your financial capabilities. Open communication is particularly important in order to avoid misunderstandings and reach a sustainable agreement.

I hope this information is helpful to you and I am available for further questions.

Sincerely,
Alice Schulz
