Ask a lawyer on the topic of Criminal law

How can I defend myself against an unjustified accusation of theft?

Dear lawyer,

I hope you can help me. My name is Anneliese Herrmann and I am currently facing a very distressing situation. A few weeks ago, I was falsely accused and charged with theft. The whole matter is very confusing and stressful for me, as I am not aware of any guilt.

The accusation is based on the statements of a person who claims to have seen me at the scene of the crime. However, I can say with certainty that I was in a completely different location at the time in question, and therefore it is impossible for me to be the perpetrator. Unfortunately, I do not have any alibis or evidence that could prove my innocence.

This situation is causing me great concern, as I do not know how to defend myself and what actions I should take to counter the unjust accusation. I fear for my reputation and future if this false accusation cannot be cleared up.

So my question to you is: How can I effectively defend myself against the unjust accusation of theft? What legal steps can I take to prove my innocence and defend against the accusation? I am grateful for any advice and support you can offer me in this difficult situation.

Thank you in advance for your help.

Sincerely,
Anneliese Herrmann

Dear Mrs. Herrmann,

I understand that the current situation is very stressful for you and understandably causes great concern and fear. It is important that you do not feel alone in this difficult situation and seek the help of an experienced lawyer to defend your rights.

First and foremost, it is important to emphasize that you have the right to defend yourself against the accusation and prove your innocence. In a criminal trial, the presumption of innocence applies, meaning that you as the accused are considered innocent until your guilt is proven in a final judgment.

To effectively defend yourself against the unjustified accusation of theft, it is advisable to consult a criminal defense attorney as soon as possible. An experienced lawyer will work with you to gather all relevant facts and evidence to prove your innocence. He will also develop a defense strategy with you and represent your interests in court.

It is important that you provide your lawyer with all relevant information that could prove your innocence. Even if you do not have specific alibis, witnesses, cell phone data, or other evidence can help confirm your innocence.

Furthermore, your lawyer should examine whether there may be inconsistencies or contradictions in the witnesses' statements that could support your innocence. He will also consider the possibility of presenting counter-evidence to support your version of events.

In any case, it is important that you actively participate in the defense and trust your lawyer. Together, you can develop the best possible defense strategy and successfully prove your innocence in court.

I wish you strength and perseverance during this difficult time. Do not hesitate to contact me if you have any further questions or need legal advice.

Sincerely,
Lukas Schlüter, Attorney
